The counter argument: Senator Brock Greenfield (R-2/Clark) said that if the code of conduct can spell out sexual harassment, it can spell out sexual contact.

Rep. Lust (R-Rapid City) moved to kill the sexual contact prohibition. Rep. Mike Stevens (R-18/Yankton) seconded. The roll call vote was 9–5 in favor of killing the proposal:
- Aye: Curd, Frerichs, Haverly, Hawley, Langer, Lust, Maher, Novstrup, Stevens
- Nay: Greenfield, Don Haggar, Mickelson, Peterson, Qualm
if they elect assholes, they'll get what they deserve.
