In order to seize land in Texas through eminent domain, a pipeline company must be a common carrier and must operate in the public good. TransCanada checked the "common carrier" box on the T4 form, even though it doesn't pipe anyone else's oil in Texas and doesn't even have a rate schedule for the pipeline it wants to extend through
Julie Trigg Crawford's land. Also, the only place to pump oil
into the Texas segment of TransCanada's pipeline is in
Oklahoma. The Texas Railroad Commission and a Paris, Texas judge, let TransCanada get away with this.
